Terms of Service

1. Acceptance
By using evotare.com and the eVotaré platform, you agree to these Terms of Service. If you do not agree, do not use the service.
2. The service
eVotaré provides a hosted, multi-tenant elections and voting platform with verifiable, Merkle-certified results.
3. Accounts & eligibility
You are responsible for safeguarding your credentials and for all activity under your account. Accounts are for a single person, and you must be authorized by your organization to use the platform on its behalf.
4. Acceptable use
You agree not to:
- use the service for any unlawful purpose;
- interfere with election integrity or results;
- attempt to deanonymize cast ballots;
- scrape or subject the service to automated abuse; or
- circumvent or probe the platform's security.
5. Organization (tenant) responsibilities
Organizations are responsible for the accuracy of their voter rolls, for obtaining lawful consent before adding voter contact details, and for compliance with their own bylaws and applicable election law.
6. Messaging & email programs
By enrolling, you consent to receive the messages described in our Messaging Terms. Message frequency varies, and message and data rates may apply. Reply STOP to opt out and HELP for help.
7. Intellectual property
The platform and its content are owned by M at B LLC. We grant you a limited, revocable license to use the service as intended.
8. Disclaimers
The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free.
9. Compliance guardrails
The Service includes optional configuration guardrails that reflect eVotaré's understanding of certain state statutory defaults for private-organization elections. These guardrails are provided for informational purposes only, are not legal advice, may be incomplete or out of date, and do not cover every jurisdiction or every rule. The absence of a guardrail for a jurisdiction or configuration is not a representation that no legal requirement applies. Customer is solely responsible for determining that its elections comply with applicable law and its governing documents, and for any attestation its administrators record in the Service. eVotaré makes no warranty that use of the Service will result in a legally compliant election.
10. Evo assistant
Evo is an optional assistant built into the eVotaré admin area. Evo is turned on or off for your organization by eVotaré at your administrators' request. When Evo is on, administrators and operators can ask it questions about your organization's voting data and settings, and in later versions ask it to prepare changes for an administrator to approve.
To answer, Evo sends the relevant parts of your organization's data, which may include voter names, email addresses, voting sessions, items, participation records and settings, to Anthropic, PBC, which provides the underlying language model, under Anthropic's commercial terms. Evo does not send secret-ballot contents unless an administrator explicitly approves a request that requires them.
Evo cannot make any change to your data without an administrator's approval in the eVotaré interface. Evo's answers are informational and are not legal, compliance or election-law advice; your organization remains responsible for its own election rules and decisions.
Evo usage is billed against your organization's support hours in 15-minute blocks of active chat time. A block starts with the first message and another is used every 15 minutes while the chat stays active.
Evo chat transcripts are retained for 90 days and then deleted. Administrators may request earlier deletion by contacting support.
11. Limitation of liability
To the maximum extent permitted by law, M at B LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
12. Indemnification
You and your organization agree to indemnify and hold us harmless from claims arising out of your misuse of the service or violation of these Terms.
13. Termination
We may suspend or terminate accounts that violate these Terms or that threaten the integrity or security of the platform.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
15. Changes
We may update these Terms from time to time. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
